{"id":3939,"date":"2015-10-09T11:18:42","date_gmt":"2015-10-09T18:18:42","guid":{"rendered":"http:\/\/www.coolkarma.com\/dharma\/?p=3939"},"modified":"2015-10-09T11:31:34","modified_gmt":"2015-10-09T18:31:34","slug":"private-message-me","status":"publish","type":"post","link":"https:\/\/www.karmabytes.net\/?p=3939","title":{"rendered":"Private Message Me"},"content":{"rendered":"<p>Do you know what ECPA is?\u00a0 Well no matter, it seems the mega-byte-billionaires don&#8217;t know much about it either.\u00a0 But for the record, its the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Electronic_Communications_Privacy_Act\">Electronic Communications Privacy Act <\/a>which defines restrictions on the use of wiretaps, telephone calls and transmission of electronic data.\u00a0 But the document was written in 1986 and a lot has changed in terms of how data is stored and there have been a flurry of <i>complimentary<\/i> actions like the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Stored_Communications_Act\">Stored Communications Act (SCA)\u00a0\u00a0\u00a0 <\/a>and the\u00a0 <a title=\"Communications Assistance for Law Enforcement Act\" href=\"https:\/\/en.wikipedia.org\/wiki\/Communications_Assistance_for_Law_Enforcement_Act\">Communications Assistance for Law Enforcement Act<\/a> (CALEA) of 1994 which now make everything clear as conduit.<\/p>\n<p>Take messaging for instance, \u00a0you know &#8230;. Instant Messages, Messenger, Chat &#8230; Facebook uses a lot of terms to qualify the interpersonal communication between two of more of its community members.\u00a0 But one word you won&#8217;t hear it using is the word PRIVATE messaging and its not a matter of semantics but rather an intentional omission because Facebook does not want to be caught in a breach of privacy.\u00a0 Especially when there is a <a href=\"https:\/\/dockets.justia.com\/docket\/california\/candce\/5:2013cv05996\/273216\">class action lawsuit<\/a> with the social networking giant data mining personal messages.\u00a0 Facebook had hoped the lawsuit that began in 2013 would be thrown out, but \u00a0<a href=\"http:\/\/mobilemarketingwatch.com\/maybe-your-private-messages-arent-so-private-facebook-in-class-action-lawsuit-for-scanning-messages-47193\/\">&#8220;The judge in the case isn\u2019t buying the argument that this is sanctioned activity under terms of service agreements users assent to when they use Facebook.&#8221;<\/a>\u00a0 Facebook isn&#8217;t alone of course. \u00a0<a href=\"http:\/\/www.hollywoodreporter.com\/thr-esq\/twitter-hit-class-action-lawsuit-823340\">Twitter has a similar class action lawsuit<\/a> over a similar snooping private conversations.<\/p>\n<p>Back in the day when I use to play in the world of CIOs and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Chief_security_officer\">CSOs<\/a> we teased about\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Security_through_obscurity\">security through obsquirity\u00a0<\/a>\u00a0and it seems to me for all of the checks and balances we pretend to have around the oxymoron of electronic privacy that we have obscured the issue sufficiently to keep us from ever questioning big brother&#8217;s watchful eye that in a nano-blink sends our URL to a third party retailer waiting to pounce on our bitcoin.<\/p>\n<p>On my end of the irrelevant n=1 case data, \u00a0my son sent me a link this morning to the brand of Iams Cat Food he wanted me to include on my online food order. \u00a0And within a matter of minutes the following IAMS advert came up on my Facebook news feed. \u00a0Not any IAMS add .. but that exact product that Dan sent me the link for. \u00a0Was FB sending information from my personal chat to one of their 3rd party vampire-vendors? \u00a0Or did FB only follow my outbound links from inside my personal message chat? \u00a0Or was it simply a coincidence?
